Terms of service

ATON Desk and this website are provided by Atheron Network Inc., through its software studio Atheron Network Labs. These terms are an agreement between Atheron Network Inc. and the business, organisation or person that creates or uses an ATON Desk workspace, called "you" here.

If you accept them for a business or organisation, you confirm you may bind it. Formal notices go to the registered address above, or to legal@aton-network.org.

These documents are part of these terms, each where it applies:

• the privacy notice, which says what we keep and why;
• the Data Processing Addendum and the list of subprocessors, for the personal information we handle for you;
• the acceptable use policy and the AI use policy;
• the service levels for your plan, and cancellation and refunds;
• the messaging terms, when you use text messages, WhatsApp, Messenger, Instagram, Telegram or Discord.

If two of them disagree about personal information, the Data Processing Addendum wins. Otherwise these terms win.

This website describes ATON Desk. It does not sell anything itself: every plan, seat and add-on is bought inside ATON Desk.

If anything here differs from what ATON Desk shows when you subscribe, what ATON Desk shows is what applies.

You sign in with an Atheron account. Keep your sign-in safe, and tell us at once if you think someone else has used it.

You decide who is on your team and what each person may do. You are responsible for what happens in your workspace, including what your team and your AI agent say to your customers.

ATON Desk is meant for businesses and organisations. Each person using it must be at least 16.

• Prices are in Canadian dollars, per seat per month unless stated otherwise. Taxes are added where they apply.
• Subscriptions are bought and managed in ATON Desk under Settings, then Billing. Stripe is the seller, so Stripe takes the payment, works out the tax and sends your receipts, under its own terms of sale.
• A subscription renews each month or each year, as you chose, until you cancel it.
• When you add seats or add-ons part way through a period, you pay for the rest of that period. When you remove them, the unused part is credited to your next bill.
• Usage beyond your plan, such as AI packs, ATON Assist top-ups and message fees, is charged as ATON Desk shows before you buy or switch it on.
• If we change a price, we tell you at least 30 days before it applies to you. It applies from your next renewal, and you can cancel before then.

The free plan costs nothing and has the limits ATON Desk shows for it, with "Powered by ATON Desk" on the chat.

The Business trial lasts 14 days and needs no card. When it ends, your workspace moves to the free plan unless you choose a paid one. Nothing is charged without your choice.

You can cancel at any time in Settings, then Billing. Your plan stays until the end of the period you paid for, then your workspace moves to the free plan. Cancellation and refunds explains what is refunded, and what happens to your history.

What your business puts into ATON Desk stays yours: conversations, contacts, files, training content and settings. You let us host, copy and process it only to provide ATON Desk to you, as the Data Processing Addendum describes.

You confirm you have the right to give us that content, and to have your customers' messages handled this way.

You can ask us at any time for a copy of your workspace: its conversations, contacts and files, in a standard format.

The AI agent and ATON Assist are AI. They answer from the content your business gives them and can make mistakes, so a person should check anything that matters.

The AI agent always tells your customers it is an AI and offers them a person. That label stays on every plan, including with white label. The AI use policy says what the AI sees and what it may do.

Follow the acceptable use policy. In short: no breaking the law, no spam, no getting into other workspaces, and never misleading people about who they are talking to.

When you connect text messages, WhatsApp, Messenger, Instagram, Telegram or Discord, the messaging terms apply too. Your business is the sender of every message, and is responsible for the consent the law requires.

We keep improving ATON Desk, so features change. If we remove something you pay for, we tell you first, and you can cancel and get back the unused part of what you prepaid.

The service levels say how available we aim to keep ATON Desk on your plan, and the credits if we fall short.

We may suspend a workspace that is not paid, that breaks the acceptable use policy, or that puts other people or the service at risk. We tell you why, and how to fix it, unless the law or the risk stops us.

You may stop using ATON Desk at any time. We may end these terms with 30 days' notice, and refund any period you prepaid and will not get, or at once for a serious or repeated breach.

When a workspace closes, we delete its content within 30 days of your asking, except what the law requires us to keep, such as billing records.

ATON Desk, its code, the widget and the ATON Desk name are ours. You may use them only as part of the service, and not copy, resell or take them apart, except as the law allows.

If you send us ideas or feedback, we may use them freely.

We provide ATON Desk with care and skill. Beyond what these terms and the service levels say, it is provided as it is: we do not promise it will be uninterrupted or free of errors, or that AI answers will be right.

Neither of us is liable to the other for indirect or consequential losses, or for lost revenue, business or data that could have been avoided by keeping backups.

Our total liability under these terms is limited to what you paid us for ATON Desk in the 12 months before the claim.

You are responsible for claims that arise from your content, or from messages your workspace sends without the consent the law requires.

Nothing here limits liability that the law does not allow to be limited.

Each of us keeps the other's non-public information confidential, and uses it only for these terms. This does not cover information that is already public, or that the law requires us to disclose.

When these terms change, we publish a new version with its date, and earlier versions stay readable on this page.

If a change matters to you, we tell your workspace's owners at least 30 days before it applies. If you do not agree, you can cancel before then.

These terms are governed by the law of British Columbia, Canada and the federal laws of Canada that apply there, and disputes are heard by the courts of British Columbia, Canada.

If you are a consumer, this does not take away the protection of the mandatory law of the place you live, or your right to bring a claim there.
